Site Credit Terms

In addition to the Terms and Conditions (“Terms”), if you elect to purchase pre-paid credits to purchase designated services on the Site (“Site Credit”) you hereby agree to the terms and conditions set forth in these Site Credit terms (“Site Credit Terms”). You understand that the Site Credit Terms are supplemental to and governed by the Terms. Any term not defined herein shall have the meaning set forth in the Terms.

By purchasing the Site Credit you understand your right to use such Site Credit constitutes a limited, non-exclusive, non-assignable, nontransferable, non-sublicensable, revocable license, and that you are using such Site Credit in your capacity as a non-consumer institutional end-user for your own internal business use (“Limited License”). Flueid, in its sole discretion and in accordance with applicable law, has the absolute right to manage and modify Site Credit without any notice or liability to you, including deletion upon termination of your account. Your purchase or use of Site Credit following any update to the Site Credit Terms constitutes your acceptance of those terms.

YOU ACKNOWLEDGE AND AGREE, NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, THAT YOU WILL HAVE NO CLAIM, RIGHT, TITLE, OWNERSHIP, OR PROPRIETARY INTEREST IN SITE CREDITS TO WHICH YOU ACQUIRE ACCESS REGARDLESS OF ANY CONSIDERATION OFFERED OR PAID IN EXCHANGE AND THAT FLUEID WILL NOT BE LIABLE IN ANY MANNER FOR THE DESTRUCTION, IMPAIRMENT, MODIFICATION, OR OTHER DAMAGE OR LOSS OF ANY KIND CAUSED TO THE AFOREMENTIONED, INCLUDING THEIR DELETION UPON THE TERMINATION OF YOUR ACCOUNT.

By purchasing the Site Credit you further understand and agree as follows:

  1. Your account may be subject to certain limits, including total balance and transaction limits, as determined by Flueid in its sole discretion;
  2. Your account must be in good standing in order to purchase or use Site Credit.
  3. Site Credit that have been purchased for, or activated in, your account can only be used for designated Services available through the Site;
  4. Consistent with Section 2 of the Terms, all payments for Site Credit are non-refundable and final;
  5. No portion of your Site Credit may be transferred to another party;
  6. Site Credit are not redeemable, unless required by law, and, if so, not redeemable in person;
  7. Site Credit will be applied first to pay for Services; provided, then to any other fees due and owing
  8. Site Credit will not expire, unless permitted by applicable law;
  9. Site credits are not deemed a currency or currency substitute, and have no monetary value except as required by law;
  10. Any added value with your purchase of Site Credit is a promotion and will expire one year after purchase, unless a different timeline is detailed in any applicable offer made to you;
  11. Your account will not terminate, unless permitted by applicable law; and
  12. See additional details as set forth in Exhibit A, attached hereto.

If you choose to delete your Flueid Pro account, you must spend your Site Credit balance prior to deleting your account.

You can check for Site Credit balance by logging into your account or by contacting Flueid Customer Service by email at support@flueid.com or by phone at (888) 835-8343. Deletion of your Flueid Pro account will result in the irrevocable loss of any Site Credit balance remaining at the time of deletion.

Flueid is not responsible for any loss, or unauthorized or fraudulent use of your Site Credit. Flueid is not responsible if you are unable to access your Site Credit or your Flueid Pro account. You agree that you will not be able to access your Site Credit if your account is involved in a payment dispute, or if your account is suspended or terminated for violating Flueid’s Terms. Flueid reserves the right to suspend, withhold, or deduct any portion of your Site Credit balance at any time if Flueid determines or suspects that your Site Credit were purchased, used, or obtained in error, fraudulently, illegally, in violation of any applicable promotion or program terms, or in violation of these Site Credit Terms.

Exhibit A

JURISDICTION-SPECIFIC NOTIFICATIONS AS TO EXPIRATION DATE, FEES AND REDEMPTION OF FUNDS (AS APPLICABLE)

Expiration Date For residents of Alabama, Alaska, Arkansas, Colorado, Delaware, District of Columbia, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts, Michigan, Mississippi, Missouri, Nebraska, New Mexico, North Carolina, Oklahoma, Pennsylvania, South Carolina, South Dakota, West Virginia, Wisconsin, and Wyoming only, THIS IS TO NOTIFY YOU that your Site Credit will expire after a period of three (3) years from the latter of the date of your last funds being loaded into your account or the date of your last activity.

Fees For residents of Alabama, Alaska, Arkansas, Delaware, District of Columbia, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts, Michigan, Mississippi, Missouri, Nebraska, New Mexico, Oklahoma, Pennsylvania, South Carolina, South Dakota, West Virginia, Wisconsin, and Wyoming only, THIS IS TO NOTIFY YOU that if your account remains inactive for a period of one (1) year from the latter of the date of your last funds being loaded into your account or the date of your last activity you may be subject to a monthly inactivity fee in the amount of one dollar ($1.00) which will be charged until the earlier of receipt of notification from you that you are terminating the account, your account reaches a zero balance or, if permitted under applicable law, your account expires.

For residents of Ohio and Tennessee only, THIS IS TO NOTIFY YOU that starting two (2) years after the effective date of the establishment of your Site Credit account if your account has been inactive for a period of one (1) year from the latter of the date of your last funds being loaded into your account or the date of your last activity you may be subject to a monthly inactivity fee in the amount of one dollar ($1.00) which will be charged until the earlier of receipt of notification from you that you are terminating the account, your account reaches a zero balance or, if permitted under applicable law, your account expires.

Redemption of Funds Excluding the residents of the states of California, Colorado, Connecticut, Montana, New Jersey, New York, Vermont and Washington, THIS IS TO NOTIFY the residents of all other states that you are not eligible to redeem your Site Credit for cash.
